onducting elections of a member of the Council of the Republic instead
 of a retired one
 In the event of revocation or early termination for other reasons of the powers of an elected
member of the Council of the Republic, new elections of a member of the Council of the
Republic are held within the period established by the Central Commission. Elections to replace
a retired member of the Council of the Republic are appointed by the Central Commission and
are carried out in the manner established by Section VI of this Code.
 If an elected member of the Council of the Republic retires less than a year before the
expiration of the term of office of the Council of the Republic, elections for a new member of
the Council of the Republic in place of the retired member are not held.

 Article 110 1 . Monitoring the constitutionality of elections of members of the Council
 of the Republic
 The Presidium of the All-Belarusian People's Assembly, no later than five days from the date
of publication of the results of the elections of members of the Council of the Republic, has the
right to apply to the Constitutional Court of the Republic of Belarus with a proposal to give an
opinion on the constitutionality of the elections of members of the Council of the Republic. In
this case, the convening of the first session of the Council of the Republic after the elections is
suspended for the period of consideration of such a proposal by the Constitutional Court of the
Republic of Belarus.
 If a proposal is submitted to the Constitutional Court of the Republic of Belarus to give an
opinion on the constitutionality of holding elections of members of the Council of the Republic,
the Presidium of the All-Belarusian People's Assembly simultaneously informs the Central
Commission about this.
 The Constitutional Court of the Republic of Belarus gives an opinion on the constitutionality
of holding elections of members of the Council of the Republic within ten days from the date
of submission of such a proposal.
 The conclusion of the Constitutional Court of the Republic of Belarus on the
unconstitutionality of the elections of members of the Council of the Republic is the basis for
the Central Commission to invalidate the elections and cancel the previously adopted decision
on the results of the elections of members of the Council of the Republic. In this case, repeat
elections of members of the Council of the Republic are appointed and held in the manner
established by Section VI of this Code, taking into account the specifics provided for by this
article.
 The decision to call repeat elections of members of the Council of the Republic is made by
the Central Commission no later than 10 days from the date the Constitutional Court of the
Republic of Belarus issued a conclusion on the unconstitutionality of the elections of members
of the Council of the Republic.

 Article 110 2 . Consideration by the All-Belarusian People's Assembly of the issue of
 the legitimacy of elections of members of the Council of the Republic
 The Presidium of the All-Belarusian People's Assembly or at least one third of the full
composition of the All-Belarusian People's Assembly, no later than five days from the date of
publication of the results of the elections of members of the Council of the Republic, has the
right to apply to the All-Belarusian People's Assembly with a proposal to consider the issue of
the legitimacy of the elections of members of the Council of the Republic. In this case, the
convening of the first session of the Council of the Republic after the elections is suspended for
the period of consideration of such a proposal by the All-Belarusian People's Assembly.
 If a proposal is made to the All-Belarusian People's Assembly to consider the issue of the
legitimacy of the elections of members of the Council of the Republic, the Presidium of the All-
Belarusian People's Assembly simultaneously informs the Central Commission about this.
 The All-Belarusian People's Assembly considers the issue of the legitimacy of elections of
members of the Council of the Republic within ten days from the date such a proposal is
submitted.
 The decision of the All-Belarusian People's Assembly on the illegitimacy of the elections of
members of the Council of the Republic is the basis for the Central Commission to declare the
elections invalid and cancel the previously adopted decision on the results of the elections of
members of the Council of the Republic. In this case, repeat elections of members of the Council
of the Republic are appointed and held in the manner established by Section VI of this Code,
taking into account the specifics provided for by this article.
 The decision to call repeat elections of members of the Council of the Republic is made by
the Central Commission no later than 10 days from the date of the All-Belarusian People's
Assembly's decision on the illegitimacy of the elections of members of the Council of the
Republic.
