Prohibition of Double Jeopardy

1. No one may be tried twice for the same act.

2. The provisions of part 1 of this Article shall not prevent the review of a case in
accordance with law in case of availability of new or newly emerged circumstances, or
where there have been fundamental shortcomings in the examination of the case
which could affect the outcome of the case.

Article 69. Right of a Sentenced Person to Appeal

Everyone sentenced for committal of a criminal offence shall have the right to have the
criminal judgment, rendered against him or her, reviewed by superior judicial
instance, on the grounds and under the procedure prescribed by law.
