. (1) Wahlberechtigt sind alle Personen, die die österreichische Staatsbürgerschaft besitzen, am Tag der Wahl das 16. Lebensjahr vollendet haben und vom Wahlrecht nicht ausgeschlossen sind. (2) Ob die Voraussetzungen nach Abs. 1 zutreffen, ist, abgesehen vom Wahlalter, nach dem Stichtag (§ 1 Abs. 2) zu beurteilen.
