§ Ind. Code § 3-10-3-2Form of public question on ballot; effect of failure to vote

(a) This subsection applies if the general assembly does not prescribe the form in
which a state constitutional amendment must appear on the general election ballot. If the
electorate of the state may vote on a state constitutional amendment or other public question,
the commission shall prepare a brief statement of the public question in words sufficient to
clearly designate it and have the statement printed on the state ballot in the form prescribed
by IC 3-11-2-15.
(b) If a voter does not vote on the public question, the ballot is void with regard to the
public question and may not be counted.
