§ Ind. Code § 3-9-4-6Preservation of reports and statements

(a) Except as provided in subsections (b) and (c), the election division and each
county election board shall preserve reports and statements for four (4) years from December
1 following the election to which they pertain, unless the records are in litigation.
(b) This subsection applies to reports and statements filed by a person that seeks to
influence the election or retention of an individual to an office with a term of more than four
(4) years. The election division and each county election board shall preserve the reports and
statements subject to this subsection until the final December 1 before the expiration of the
term for the office, unless the records are in litigation.
(c) If a report is a duplicate of a report required to be filed under the federal Election
Campaign Act (52 U.S.C. 30101 et seq.), the report may be discarded on January 1 of the
second year after the report was filed.
