1 A person falls within this section if the person holds a relevant elective office or a relevant Scottish elective office. 2 For the purposes of subsection (1) a person is to be treated as holding a relevant elective office or a relevant Scottish elective office during any period when— a the person has been elected as, or declared to be returned as, the holder of the office, but b their term of office has not yet begun.
