149 If a person makes any agreement or terms, or enters into any undertaking, in relation to the withdrawal of an election petition, and such agreement, terms or undertaking— a is or are for the withdrawal of the election petition in consideration of any payment, or in consideration that the seat or office should at any time be vacated, or in consideration of the withdrawal of any other election petition, or b is or are (whether lawful or unlawful) not mentioned in the affidavits referred to in section 148 above, he shall be liable— i on conviction on indictment, to imprisonment for a term not exceeding one year, or to a fine, or to both; ii on summary conviction, to imprisonment for a term not exceeding 6 months, or to a fine not exceeding the statutory maximum, or to both .
