Podstawową jednostką samorządu terytorialnego jest gmina. Inne jednostki samorządu regionalnego albo lokalnego i regionalnego określa ustawa. Gmina wykonuje wszystkie zadania samorządu terytorialnego nie zastrzeżone dla innych jednostek samorządu terytorialnego.
