(1) Estonian citizens and citizens of the European Union who have attained 16 years of age by the election day and whose permanent residence, i.e. residential address with legal effect for the purposes of subsection 1 or 2 of § 65 of the Population Register Act, is located in the corresponding rural municipality or city, have the right to vote. [RT I, 07.01.2026, 1 – entry into force 17.01.2026] (2) [Repealed – RT I, 20.05.2025, 1 – entry into force 01.03.2026] (3) A person who has been divested of their active legal capacity with regard to the right to vote does not have the right to vote. (4) A person who has been convicted by a court and is serving a sentence in a penal institution may not participate in voting. (5) Every Estonian citizen and citizen of the European Union who has the right to vote, who has attained 18 years of age by the last day for the registration of candidates and whose residential address with legal effect for the purposes of subsection 1 or 2 of § 65 of the Population Register Act is located in the corresponding rural municipality or city according to the data of the population register not later than on 1 August of an election year, has the right to stand as a candidate.
