§ Art. I-63Basic Principles of Filing Complaints against Decisions, Actions, or Inaction Relating

to the Election Process
 1. Decisions, actions, or inaction relating to the election process may be contested by filing a
complaint to a court or to an election commission.
 2. Filing a complaint against a decision, action, or inaction relating to the election process
with a court, as well as consideration and resolution of cases by the court shall be carried out in
accordance with the procedure established by the Code of Administrative Adjudication of Ukraine.
 3. Filing a complaint against a decision, action, or inaction relating to the election process
with the respective election commission, as well as consideration of cases and adoption of a
decision by the election commission shall be carried out in accordance with the procedure
established by this Code.
 4. A court with which a lawsuit has been filed shall immediately notify the respective election
commission and a higher-level election commission (with regard to the voter list, a court shall also
notify the State Voter Register maintenance body) of the receipt of the lawsuit, instituting

 

proceedings or refusal to open proceedings in the case, as well as of the decision adopted by the
court.
 5. If a court initiates proceedings upon an administrative lawsuit related to the same matter
and on the same grounds and initiated by the same subject as a complaint filed with an election
commission, the election commission shall, upon being notified of the administrative lawsuit by
the court, cease the consideration of the said complaint.
 6. Courts, election commissions, the State Voter Register maintenance bodies, law
enforcement bodies shall organize their work during the election process, including on weekends
and on the day of voting, so as to ensure the receipt and consideration of complaints (lawsuits) and
addresses of election commissions within the time frame and in the manner prescribed by this
Code.
 7. Issues related to consideration of complaints by election commissions which are not
regulated by this Code shall be resolved by the Central Election Commission.
