Problems that may not be subject to the local referendum
(1) The local referendum may not address the following problems:
a) of national interest, falling within the competence of the Parliament, the Government
or other central public authorities, in accordance with the powers laid down by the Constitution
and by legislation;
b) related to the internal and external policy of the State;
c) which conflict with the provisions of the Constitution and of the legislation of the
Republic of Moldova;
d) related to taxes and budget;
e) related to extraordinary or emergency measures to ensure public order, health and
safety of the population;
d) related to the election, appointment, dismissal and removal from office of persons
falling within the competence of Parliament, the President of the Republic of Moldova and the
Government;
g) related to the removal from office of the mayor, dismissed based on the final
dismissal decision of the court;
h) which fall within the jurisdiction of the courts or the prosecutor’s office;
(2) By way of derogation from paragraph (1), the merger of several localities of the
same level may be subject to the local consultative referendum.
