§ Electoral Act s. 57Determination and declaration of final result of election

(1) The Commission
must determine and declare the result of an election by adding together the results received
from all voting stations.
(2) The determination and declaration of the result of an election must occur within
seven days afterthe voting day, butnot( a ) sooner than 21:OO of the second day after the voting day; or
( b ) before all objectionsmadeundersection
55 havebeen dealt withinterms of
that section, other than an appeal to the Electoral Court in terms of subsection
( 5 ) of that section.
(3) The Commissionmaydetermineanddeclarethe
result ofanelectionwithout
having received theresults of all voting stations, if( a ) to wait for the receipt of the result from every voting station would unduly and
unreasonably delay the determination and declaration of the result of that election; and
(b) the outstanding results are not likely to materially influence the overall result of
that election.
(4) If theCommission is unable to determineanddeclarethe
result of an election
within the seven-day period required by subsection (2) (c), the Commission must apply to the
Electoral Court foran extension of that period.
( 5 ) The Electoral Court, on good cause shown, may extendthe period within which the
Commission must determine and declarethe result of an election.
AGENTS
58.Appointment of party agents.-(1) Everyregisteredpartycontesting an election
may appoint(a) two party agents for each voting station; and
( b ) four party agents for each venue where the proceedings provided for in Part 3 or
5 of Chapter 4 take place.
(2) A party agent( a ) must be a South African citizen; and
(b) may not be a candidate in an election.
(3) The appointment and revocation of appointment of a person as a party agent must
be effected in the prescribed manner.
