(1) Subject to subsection (2), the staff of the Commission shall consist of: (a) persons engaged under the Public Service Act 1999 (including such persons holding offices established by this Division); and (b) persons employed or engaged by the Commission under this Division. (2) For the purposes of the Public Service Act 1999 : (a) the Electoral Commissioner and the APS employees assisting the Electoral Commissioner together constitute a Statutory Agency; and (b) the Electoral Commissioner is the Head of that Statutory Agency.
