False declaration on nomination paper. 143. —(1) In case a person who, being a candidate or the proposer of a candidate at a Dáil election, makes a declaration on a nomination paper that he has read the notes on the nomination paper and believes the candidate to be eligible for election under this Act then if the candidate is not eligible for election under this Act the person shall be guilty of an offence. (2) In a prosecution for an offence under subsection (1) , it shall be a good defence for the defendant to show that he had reasonable grounds for believing that the candidate was eligible for election.
