(a) The commission may impose a civil penalty against a person as provided by this subchapter only after a formal hearing as provided by Subchapter E, Chapter 571, Government Code. (b) The commission shall base the amount of the penalty on: (1) the seriousness of the violation; (2) the history of previous violations; (3) the amount necessary to deter future violations; and (4) any other matter that justice may require.
